Yi Liu, Senior Partner at Everbright and Head of its Hong Kong office, followed with remarks highlighting Hong Kong’s institutional advantages in cross-border dispute resolution—especially its common law system, judicial independence, and international recognition. As one of the first mainland law firms to establish a presence in Hong Kong, Everbright has long been engaged in facilitating legal collaboration between the two jurisdictions and has accumulated practical experience in out-of-court restructuring, mediation, and insolvency cooperation. He also referenced the firm’s success in a milestone cross-border case known as the “Shanghai First Case.”

The forum featured two Hong Kong legal experts who had been deeply involved in a project concerning the investigation and equity recovery of an overseas subsidiary of a Shanghai-based company. Working alongside Everbright’s Hong Kong office, they provided legal opinions under Hong Kong law and appeared in court. Their joint efforts helped secure recognition and assistance from the Hong Kong High Court for a mainland insolvency proceeding—setting a precedent for Hong Kong–mainland cooperation in cross-border bankruptcy and dispute resolution.

In her keynote speech, Wenny Huang, Vice President and Secretary General of eBRAM, addressed “Technology-Enabled Multi-Tiered Dispute Resolution Mechanisms.” She introduced eBRAM’s efforts to build online arbitration and mediation platforms aimed at improving efficiency and reducing legal costs for overseas disputes. She highlighted the importance of such tools in emerging sectors like cross-border e-commerce and digital trade, where online mediation and AI-assisted resolution will play a growing role. Ms. Huang noted that Hong Kong’s unique position at the intersection of Eastern and Western legal traditions gives it a distinct institutional flexibility in handling complex disputes.

圆桌讨论环节，五位嘉宾从不同角度展开深入分享。香港朱国熙、黄锦华律师事务所资深律师利名汇详细阐述内地与香港民商事判决相互认可与执行安排的制度更新，指出内地判决条例在判决范围、适用主体和执行路径方面的优化，有助于提升商业争议解决的可预期性与可操作性。德辅大律师事务所（香港）大律师陆栩然回顾了“境内破产程序获得香港高等法院认可与协助”案件的司法路径，并从普通法视角解析香港法院在跨境协助中如何平衡实体正义与程序合法。光大郑州分所合伙人李琦则结合自身在庭外重组中的实务经验，分享了律所如何协调内地法院与香港团队、境外债权人之间的多方沟通机制。同济大学法学院经济法教研部主任、副教授夏凌从法学研究角度，提出构建区域性争议解决平台需依托制度创新与实践推动双轮驱动，建议进一步推动调解协议的域外承认规则。今日资本总法律顾问张祺指出，企业在出海过程中最关注的是解决方案的效率、成本与最终落地效果，强调法律服务必须“懂商业逻辑、讲国际语言、可跨文化操作”。

Isaac Lee, Senior Associate at Patrick Chu, Conti Wong Lawyers LLP (Hong Kong), provided a detailed analysis of the updated Arrangement on Reciprocal Recognition and Enforcement of Civil and Commercial Judgments between Hong Kong and the mainland. He noted improvements in scope, applicability, and execution procedures, enhancing predictability and operability for commercial dispute resolution. Michael Lok, Barrister at Des Voeux Chambers (Hong Kong), reviewed the legal path of the aforementioned “Shanghai First Case” and explained how Hong Kong courts balance substantive justice and procedural legality under the common law framework in cross-border judicial assistance. Qi Li, Partner at Everbright (Zhengzhou), shared practical insights from his experience in out-of-court restructuring, emphasizing how firms can coordinate between mainland courts, Hong Kong counsel, and overseas creditors. Dr. Ling Xia, Associate Professor and Head of the Economic Law Department at Tongji University Law School, advocated for building regional dispute resolution platforms based on both institutional innovation and empirical legal practice. She called for enhanced mechanisms to support the cross-border recognition of mediation agreements. Qi Zhang, General Counsel of Capital Today, pointed out that outbound enterprises prioritize efficiency, cost control, and enforceability in legal solutions. He stressed that legal services must “understand business logic, speak the language of international commerce, and operate across cultural contexts.”
